Accrues to the Operator each month (a part-month counts as a full month's accrual, except the final month which accrues daily) from the Commencement Date until the 'Last Accrual Date' (the date the resident vacates/dies and possessions are removed). Payable 5 working days after the Operator settles the licensing of the unit to a new resident (ORA clauses 8.3.1-8.3.3).

Weekly fee

Called the 'Village Outgoings Charge' - the dollar figure is resident-specific and left blank in this template ORA, so no number is published.

Full research note

Called the 'Village Outgoings Charge' - the dollar figure is resident-specific and left blank in this template ORA, so no number is published. It is explicitly NOT fixed: the Operator may increase it each 1 April, capped at the greater of 2.5% or the change in CPI since the same quarter the previous year (Part C, clause 1).

Capital gain (a rise in the unit's value)

RETAINED BY THE OPERATOR, not the resident. ORA clause 20.5.5: 'Any capital gain arising out of termination of this Agreement is retained by the Operator.

RETAINED BY THE OPERATOR, not the resident. ORA clause 20.5.5: 'Any capital gain arising out of termination of this Agreement is retained by the Operator. Any capital loss arising out of the termination of this Agreement and re-sale of the unit is borne by the Operator.'

When you are repaid

Capital Sum (entry payment) is repaid 5 working days after the date the Operator settles the payments under a licence of the Unit to a new resident (clause 21.2).

Source: speldhurstcountryestate.co.nz

Full research note

Capital Sum (entry payment) is repaid 5 working days after the date the Operator settles the payments under a licence of the Unit to a new resident (clause 21.2). If the Operator itself terminates the agreement (clause 20.1 grounds), repayment is within 5 working days of the resident vacating OR the new-licence settlement date, whichever comes first (clause 21.1). No fixed outer backstop date is given beyond this contingency.

Disclosure statement (the village's summary of the deal)

Not published online. The law says the village must give you one before you sign an occupation right agreement (the contract that lets you live there), and it sets out every fee. Ask for it early.

What would you get back?

$480,000 backExit fee 20.0% = $120,000 kept by Wayne Bishop Investments Limited after 5 years. Weekly fees are extra.

The exit fee builds over 5 years to 20%. The calculator spreads it evenly over those years; the exact schedule is in the fee notes above. Before weekly fees and any other charges.

Confidence: High. (for the clauses quoted - direct legal text); Capital Sum/weekly fee $ amounts are genuinely not published anywhere found

Research note

This is the strongest-sourced entry: I read the full legal ORA text myself after catching that our page reader's first pass over the same PDF had fabricated a '10%/90% capital gain split' that is not in the document - the real clause says the Operator keeps 100% of any capital gain. Registration No. of Village: 2635411 (from the ORA's lawyer certification page), Operator: Speldhurst Country Estate Limited, at 70 Kimberley Road, Levin.
